I'm going to be honest. This looks like it was intentional. I'm not entirely sure what happened here but either a mistake was made or the landowner was taken advantage of. If it is was a mistake, it makes a lot more sense to own up to it. There's no reason for it to be left out. If you're going to leave it out perhaps you should inform people as to why.
