On November 15, 2019 Environmental Compliance Approval with Limited Operational Flexibility (Air) No. 6376-BFQJYS was issued to Cargill Limited, operating as Cargill Protein, a poultry processor and producer of prepared frozen, chicken-meat products for the retail restaurant industry.  The facility is located in the City of London, Ontario.

This approval is for all sources at the facility including:

  • live bird receiving
  • bird stunning
  • processing including slaughtering, scalding, evisceration, chilling, de-boning, frying
  • packaging
  • wastewater pre-treatment

Emissions to the air from this facility include:

  • particulate matter
  • nitrogen oxides
  • carbon dioxide
  • sodium hydroxide

The Environmental Compliance Approval with Limited Operational Flexibility (Air) No. 6376-BFQJYS requires that the company demonstrate compliance on an ongoing basis with Ontario Regulation 419/05, applicable Ministry Guidelines for Air and Noise and other performance requirements as specified in their conditions.

It permits modifications such as process changes, de-bottlenecking, or addition of new equipment subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air).

The limited operational flexibility conditions have an expiry date.

Comments received were reviewed and, where appropriate, were considered in the our decision whether or not to proceed with this proposal.

For this proposal, the concerns raised were related to wastewater, climate change, and odour. Wastewater and climate change are outside the scope of the proposal’s compliance with relevant legislation, under which the decision to proceed with the Air approval was made. The ministry issued a wastewater approval for the facility in October 2017 (ERO reference No. 013-1271), for which no public comments were received. The proposed changes do not trigger an amendment to the existing wastewater approval.

Comments regarding odour are consistent with concerns within the ministry and as a result terms and conditions were added. The terms and conditions do not represent all conditions in the Approval, but are those related to the comment on the proposal. The terms and conditions included in the Approval include: Proper Operation and Maintenance; Preparation of an Odour Management Plan; and Complaints Recording and Reporting.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to Environmental Compliance Approval with Limited Operational Flexibility (Air) No. 2427-ALLGYJ, which replaces all the current Environmental Compliance Approvals for Air at this facility and includes the addition of new or historically unapproved sources for all emissions from Cargill Limited, a poultry processing facility located in the City of London, Ontario.

The proposal includes all sources at the facility, including:

  • natural gas combustion units
  • CASlive receive process carbon dioxide exhausts
  • modified production rate
  • modified cleaning-sanitizing and cooling water chemical product uses

Contaminant emissions to the air from this facility includes:

  • particulate matter
  • vegetable oil
  • carbon dioxide
  • nitrogen oxides
  • sodium hydroxide
  • potassium hydroxide

The Environmental Compliance Approval with Limited Operational Flexibility (Air), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air). The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.
