Decision details

An approval was granted to increase the maximum amount of waste received to 950 tonnes per day and the maximum amount of waste present at the site any time not to exceed 800 tonnes.

There is no change in waste type and the waste will be processed and stored inside the building. Outside storage of waste is prohibited.

The Financial Assurance has been updated to reflect the increase in the amount of waste received and stored at any time.

Effects of consultation

One comment asked if there was there any change in waste type from the originally approved waste type.

Response: there is no change in waste type so the comment regarding change in waste type did not affect the decision.

One comment was about the site having a fire code infraction and is required to provide fire safety assessment is the facility adequate to handle the increased capacity.

Response: There was an infraction order issued for the site by the local fire department. This issue was deemed administrative in nature instead of technical. For this reason, it had no affect on the waste approval.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:

    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision

    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Proposal details

This proposal is to amend Environmental Compliance Approval (waste disposal site) No. 5165-8NVQMU for the Danville site, a 0.07-hectare non-hazardous solid waste transfer and processing facility located in the City of Mississauga, Regional Municipality of Peel, and operated by Waste Management of Canada Corporation.

The proposed modifications include:

  1. Increasing the maximum amount of waste received per day from 750 tonnes to 950 tonnes.
  2. Increasing the maximum amount of waste present on the site at any time, including waste destined for recycling, from 600 tonnes to 800 tonnes.

The facility operates 24 hours per day, 7 days per week.
