The Ministry of Municipal Affairs and Housing approved on July 7, 2021 the new County of Prince Edward Official Plan subject to eleven (11) modifications.  The Official Plan, as approved, is consistent with the Provincial Policy Statement (PPS) 2020 and serves to guide land use planning decisions in the County.

Decision details

The new Official Plan, as approved with modifications provides guidance in land use planning decisions in the County aimed at building strong and resilient communities that:

  • offer a broad range of housing types (including affordable housing and additional residential units);
  • fosters economic development and tourism opportunities; and
  • manages growth that is financially feasible while optimizing investments made in public infrastructure and services.

The new Official Plan also contains policies to guide land use planning decisions aimed at protecting and managing the County's resources, including but not limited to:

  • protecting a natural heritage system containing a variety of provincially and locally significant natural heritage features (e.g. wetlands, areas of natural and scientific interest, wildlife habitat); 
  • protecting prime agricultural areas for the long-term use of agriculture;
  • protecting mineral aggregate resources and operations from incompatible activities;
  • protecting groundwater and surface water when considering development applications; and
  • protecting cultural and archaeological heritage resources.

The Official Plan, as approved with modifications, is consistent with the Provincial Policy Statement (PPS) 2020. The eleven (11) Ministerial modifications were necessary to ensure matters of provincial interest are protected. An overview of the modifications is as follows

  • Provide clarity with respect to the development of Accessory Residential Units (ARUs) in accordance with the provisions of the Planning Act
  • Be consistent with the PPS with respect to:
    • Require the County to maintain the ability to accommodate 15 years of supply of housing;
    • Protect employment areas for the long-term;
    • Clarify uses permitted in prime agricultural areas;
    • Protect mineral aggregate operations and known deposits of mineral aggregate resources; and
    • Protect water quality when considering large developments and confirm sufficient wastewater reserve capacity when considering lot creation.
  • Ensure the existing Secondary Plans of the County’s Urban Areas are carried forward as part of the Minister’s approval as they provide the planning policy details for permitted uses and development in these areas.

Other Information

Pursuant to subsection 17 (36.5) and (38.1) and subsection 21(3) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding the Official Plan for the County of Prince Edward adopted in accordance with Section 17 and Section 26 is final and not subject to appeal. Accordingly, the Official Plan, as approved by the Minister, came into effect on July 8, 2021.

Effects of consultation

Five of the 6 submissions MSOE received were from individual land owners with properties outside of settlement areas that objected to the land use designations (e.g., prime agricultural or shore land) or policies that restricted the potential for lot creation/development in the rural area. Based on the county’s record of engagement/consultation all persons were afforded an opportunity to voice their concerns to local council prior to council adopting the Official Plan, including anyone who has development applications submitted to County for approval. Respecting Council’s decision, authority, and discretion to determine what is locally appropriate for scale of residential development in rural areas and proposed identification/designation of prime agricultural areas, MSOE staff did not suggest any modifications relating to lot creation in the rural areas or designation of prime agricultural areas.

The other submission was regarding regulating the appropriate development in and around watersheds which MSOE staff opine no further changes are required as the OP already addresses this matter.

Partner ministries supported MSOE staff in evaluating any and all submissions that touched upon their respective provincial interests/mandates

Proposal details

Prince Edward County has adopted a new Official Plan on February 24, 2021 to serve as its land use planning document guiding growth and development for a 25 year planning horizon. The new Official Plan will replace the current Official Plan approved by the Ministry of Municipal Affairs and Housing in 1998. The new Official Plan has been developed to protect matters of provincial interest as described in the 2020 Provincial Policy Statement (PPS). The new Official Plan seeks to guide growth in building strong and healthy communities, protect natural heritage features and resources, and protect public health and safety when considering development applications. The Minister of Municipal Affairs and Housing is the approval authority for the new Official Plan.

Pursuant to subsections 17(36.5) and (38.1) and subsection 21(3) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal. The proposed official plan, once approved, will replace the current official plan.
