Decision on instrument
58-C-206495 was approved on April 22, 2021. Conditions were added. Applicants have one (1) year to satisfy conditions otherwise approval will lapse. The last day that this decision can be appealed is May 13, 2021.
Non-standard conditions include:
- Notifications for acknowledgement in all Agreements of Purchase and Sale, or alternatively, an acknowledgement by the transferor and transferees if the transaction is between family members, on standard Ministry and partner Ministry guidelines and policies including: groundwater quality and quantity, potable water, sewage disposal facilities, and domestic waste.
- That prior to final approval, written confirmation is received by this ministry which states that there is adequate capacity to dispose of hauled sewage generated by the severed and retained lands.
- That prior to final consent, this Ministry must receive written consent from the Local Roads Board (LRB) that the granting of this consent would not have an adverse effect on LRB operations, and they have no objection to the creation of the new lot.
- That prior to final approval, the applicant shall enter into a Consent Agreement for each new lot with the Ministry of Municipal Affairs and Housing, to its satisfaction, addressing the use and potential development of the new lot, including the lots can only be used for resource-based recreational uses (including a recreational dwelling) and is not to be used for permanent residential use.
- That prior to final approval, the applicant is to provide written confirmation from a licensed well driller that adequate potable water (including appropriate treatment option(s) to make the water aesthetically suitable for human consumption) and pumping capacity is available on the proposed retained property.
Effects of consultation
An email was received on February 4, 2021 from a member of the public interested in acquiring relevant details regarding the proposal, including information, maps of location, and description of potential uses of a resource-based recreational lot. Additionally, the inquirer requested to be informed of the decision of the Minister in respect of this proposed consent. Further to the request, on February 5, 2021 the inquirer was sent, via email, (1) a copy of the application form, (2) sketches provided with the application, and (3) a copy of the statutory declaration regarding the easement on the subject lands.
No referrals, appeals or contentious issues were received, resulting in no impact on the decision on whether to proceed.

Proposal Details
This application is with respect to a legal merger of title that occurred in 2017. The purpose of this application is to sever two legally merged lots to create one (1) new resource-based recreational lot within the Unincorporated Township of Lyon in the District of Thunder Bay.
The effect of this application is to legally sever the proposed retained lands, PIN 62484-0147, from the adjacent property, PIN 62484-0146, as they have legally merged after one of the parties on title passed away in 2017. The proposed severed lands are 64.4 hectares with 812.2 metres of frontage and 862.8 metres of depth. The proposed retained lands are approximately 64.8 hectares with 805.9 metres of frontage and 804.7 metres of depth.
