Aggregate Resources Act (ARA) Licence #626172 was issued on April 20, 2021 to James Dick Construction Limited to extract aggregate from a pit below water. The licensed area is 124.9 hectares in size and a combined annual tonnage of 1,800,000 tonnes with adjacent ARA licenced site #5602, also licensed to James Dick Construction Limited.

Effects of consultation
Four (4) comments were received in response to the Environmental Registry of Ontario notice.
The comments expressed related to:
- zoning
- water quality
- impacts to groundwater
- traffic
- land use compatibility
- property values
Sixteen (16) letters of objection were received in response to the ARA consultation process. The concerns were related to protection of:
- the natural environment
- provincial plan conformity and zoning
- water quality
- quantity and groundwater monitoring
- traffic
- noise
- dust and air quality
- land use compatibility
- property values
The applicant worked to address the comments and objections received during consultation by providing additional information and through revisions to the site plan. At the conclusion of the ARA process there were six unresolved objections.
The application and unresolved objections were referred to the Ontario Land Tribunal (formerly the Local Planning and Appeal Tribunal) for a hearing which was held on March 22, 2021 and March 26, 2021. The Ontario Land Tribunal directed the Minister to issue the licence based on the site plan filed in the hearing.

This notice was updated on December 27, 2019 to advise the public that this application under the Aggregate Resources Act has been referred by the Ministry of Natural Resources and Forestry to the Local Planning Appeal Tribunal. Please refer to http://elto.gov.on.ca/tribunals/lpat/e-status/ for information on scheduled hearings of the Local Planning Appeal Tribunal.
This notice was updated on August 6, 2019 to advise the public that there has been no change to the status of the proposal and it is still being considered. No additional opportunity for comment is being provided for at this time.
Description of instrument
James Dick Construction Limited has applied for a Class “A” licence (pit below water) to remove aggregate from below the established water table. The proposed licenced area is 125 hectares (ha) in size, with an extraction area of 112 ha. The maximum annual tonnage applied for is 1,800,000 tonnes per year (a proposed combined tonnage limit with existing licence #5602). The application proposes that the site will operate as an extension to the adjacent pit, licence #5602, known as the “James Dick Erin Pit”, also owned by the applicant. The proposed site is located approximately 1km west of the village of Belfountain.

Comments received through Environmental Registry should not be construed as an objection under the Aggregate Resources Act in accordance with section 4.0 – Notification and Consultation Standards of the Provincial Standards 1.0 under the ARA. To be considered as a formal objector, individuals need to contact the MNRF contact person specified on this notice to determine how to submit an objection.
Other public consultation opportunities
Under the Aggregate Resources Act, written notice concerning this application was delivered to landowners within 120 metres of the proposed licenced boundary; an information sign, giving notice to the public of this application, was erected at the proposed site; and a Notice of Application appeared in the local paper, the Caledon Enterprise on July 6, 2017. A public information session was held on July 27, 2017 between 7 p.m. and 9 p.m. at the Erin Community Centre located at 14 Boland Drive, Erin ON.
The application for this proposal is being circulated within the Aurora District MNRF office. Additionally, notification of this application has been forwarded to the Town of Caledon, Town of Erin, Regional Municipality of Peel, County of Wellington, Credit Valley Conservation Authority, Ministry of Environment and Climate Change, Niagara Escarpment Commission, and the Ministry of Agriculture Food and Rural Affairs for comment.
All comments will be considered as part of the decision-making by the Ministry if they:
- are submitted in writing;
- reference the EBR Registry number; and
- are received by the Contact person within the specified comment period
