Decision details
A decision was made on March 11, 2024 to approve City of Brantford Official Plan Amendment No. 5 adopted pursuant to sections 17 and 26 of the Planning Act by By-law 97-2023. Notice of this decision was issued on March 11, 2024 to the City of Brantford.
The adopted official plan amendment was reviewed for consistency with provincial plans and policies and regard for matters of provincial interest set out in the Planning Act.
Official Plan Amendment No. 5 amends the City of Brantford Official Plan to redesignate lands from the Core Natural Areas Designation and Adjacent Lands Overlay to other land use designations, including Agricultural, General Employment, Intensification Corridor, and Residential designations.
Pursuant to subsections 17 (36.5) and (38.1) of the Planning Act, this decision is final and not subject to appeal. Accordingly, the City of Brantford Official Plan Amendment No. 5, as approved by the Minister, came into effect on March 11, 2024.
The official plan amendment applies to City of Brantford Official Plan Schedules 1, 2, 3, 4, and 6.
Effects of consultation
One comment was submitted directly to the Ministry following the City’s adoption of Official Plan Amendment No. 5. The comment requested removing additional land from the Natural Heritage System and redesignating these lands “Residential”. No modifications were made as the request was not supported by the Natural Heritage System refinement work completed by the City of Brantford as part of their Municipal Comprehensive Review, and does not conform with A Place to Grow: Growth Plan for the Greater Golden Horseshoe policy 4.2.2 which stipulates that refinements to the Natural Heritage System for the Growth Plan may only occur through a Municipal Comprehensive Review.

Proposal details
On May 23, 2023, the City of Brantford adopted Official Plan Amendment No. 5 by By-Law 97-2023. The Official Plan Amendment is now before the Minister of Municipal Affairs and Housing for a decision in accordance with Sections 17 and 26 of the Planning Act.
Official Plan Amendment No. 5 proposes to redesignate lands from the Core Natural Areas Designation and Adjacent Lands Overlay on Schedule 6 of the City of Brantford Official Plan to align with the Growth Plan Natural Heritage System that was revised as a result of refinements requested by the City of Brantford. These lands would be redesignated to other land use designations, including Agricultural, General Employment, Intensification Corridor, and Residential designations.
If approved, the mapping changes of Official Plan Amendment No. 5 would apply to City of Brantford Official Plan Schedules 1, 2, 3, 4, and 6.
