The proposal uses existing equipment at the approved site and has no impact on daily operations.
The plastic and aluminum are recovered from the process and the spent coffee grinds and tea leaves can be diverted for composting. The process takes place entirely within the facility's existing processing equipment.
Existing terms and conditions of the site's ECA were revised to include used beverage pods as a waste type that may be accepted and processed at the site.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?

Proposal details
This proposal is for an amendment to Environmental Compliance Approval (waste disposal site) No. A650041, issued to Canadian Liquids Processors Limited for the use and operation of a facility that processes recyclable post-consumer beverage pods, commonly known as coffee or tea pods, from residential and commercial sources, located at 15 Biggar Avenue in Hamilton, Ontario.
These beverage pods consist of individual packaging made of recyclable plastic or aluminium. The spent coffee or tea grinds are collected and used in composting processes, thereby further enhance municipal waste recycling programs in Ontario.
The CLP facility in Hamilton holds an Environmental Compliance Approval issued by the Ministry of the Environment, Conservation & Parks (MECP) has a total facility area of 3.62 hectares, that has been in operation for over 30 years for processing and transfer of solid non-hazardous waste including:
- domestic waste, institutional, commercial and industrial waste,
- blue box materials up to 3,750 cubic meters of unprocessed glass per day, and
- other liquid waste including, processed organics and waste from food processing/preparation operations up to 250 cubic meters per day
This amendment will not increase the amount of recyclable materials that are being received each day or increase the maximum quantity of recyclable materials in storage at any one time. The site operates 24 hours a day, 7 days a week and serves Canada and United States of America.
