A new Environmental Compliance Approval was issued to 2566593 Ontario Inc. for approval of the establishment of works for the treatment of sanitary sewage and subsurface disposal of treated effluent from a new 24 one-bedroom residential units apartment building, to be located at 53 Bridgewater Road, Hamlet of Actinolite, Municipality of Tweed, County of Hasting.
The approved works were designed for a maximum daily flow of 13,200 litres per day.
The approved works consist of:
- one anaerobic digester septic tank
- one flow equalization/balancing tank
- one Waterloo Biofilter treatment system
- one raised Type A dispersal bed

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

Original proposal
Proposal details
This proposal is for a new Environmental Compliance Approval for the establishment of subsurface sewage disposal works, rated at 17,600 litres per day, to service a 24 unit apartment building located at 53 Bridgewater Road in the Town of Tweed, Ontario.
The proposed works include:
- one 36,000 litre primary anaerobic septic tank, discharging via an OBC effluent filter to one 18,000 litre balancing tank/pump chamber, equipped with a dual submersible effluent pump
- one 45,400 litre Waterloo Biofilter media tank, complete with three media baskets, spray manifold and controls
- one 6,000 litre capacity pump chamber, equipped with minimum 550 W duplex submersible pumps to deliver timed doses to the subsurface disposal system via a forcemain
- eight Type A Dispersal Bed cells, each of 25 square metre area
The ministry may require effluent monitoring and may impose effluent limits.
