Decision details
On July 21, 2023 we issued an Environmental Compliance Approval No. 1557-CQ4SUP for a 1.33-hectare waste disposal site (processing/transfer) to receive, temporarily store, process (filter the liquid waste) and transfer up-to a maximum of one cubic metre per day of liquid waste and one tonne per day of solid waste, comprising the following facilities:
- Transfer Station within the meaning of O. Reg. 105/09: DISPOSAL OF DEADSTOCK under Food Safety and Quality Act, 2001, S.O. 2001, c. 20, as amended, comprising the following buildings and tanks:
- one 105 square metres office building
- one 105 square metres supplies storage building
- one 1,100 square metres solid waste storage building
- one 70 square metres storage building
- two in-ground concrete tanks, each with a maximum storage capacity of 7.6 cubic metres (2,000 US gallons), for storage of wastewater generated at the site
- two tanker storage trucks, each with a maximum storage capacity of 45 cubic metres, for storage of fats, oils and greases (FOG)
It is to be used for:
- transfer of the following types of waste: regulated dead animals as defined O. Reg. 105/09: DISPOSAL OF DEADSTOCK under Food Safety and Quality Act, 2001, S.O. 2001, c. 20, as amended, including organs, unwanted meat from butcher shops, restaurants and other food/meat processing facilities and waste that is classified as "Specified Risk Materials" which has the same meaning as in section 6.1 of the Health of Animals Regulations (C.R.C., c. 296), made under the Health of Animals Act (S.C. 1990, c. 21), as amended
- processing and transfer of the following types of waste: fat, oil, grease (FOG) from butcher shops, restaurants and other food/meat processing facilities
The service area is the Provinces of Ontario and Quebec. The approved operating hours are as follows:
- waste and the reagents may be received at the site and shipped from the site only between the hours of 7:00 a.m. to 5:00 p.m. Monday to Friday
- the approved waste management activities may be carried out at the site between the hours of 7:00 a.m. to 5:00 p.m. Monday to Friday
The approval also allows the owner to occasionally receive or ship waste or reagents to or from the site or carry out the approved waste management activities at the site until 7:00 p.m. Monday to Friday or 7:00 a.m. to 5:00 p.m. on Saturdays.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:

- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see

- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?

Proposal details
The proposal is for an Environmental Compliance Approval (organic waste transfer site) for a non-hazardous solid waste transfer facility. This transfer site is a 1.33 hectare property located at 1125 and 1133 Route 900 East in St. Albert, Ontario.
The site has been operated by Sanimax since 2004. The operations include transferring and temporary storing of organs, unwanted meat and grease from butcher shops, livestock farms, restaurants, and other food/meat processing facilities. The organic waste is brought to the site and temporarily stored in various areas throughout the site, depending on the type of waste. The material is then removed from the site for processing and disposal at an off-site location.
The maximum quantity of waste delivered to the site on any given day is approximately 45 tonnes, and 12,000 tonnes annually. The site operations take place five (5) days a week, from 7:00 am to 5:00 pm, year-round except for statutory holidays. The site services Eastern Ontario and Western Quebec.
