Decision details
Application 59-C-220755 for a road access easement was approved on September 27, 2022 subject to the following conditions:
1. That the following documents be provided for the transaction:
(a) A copy of the application to transfer documents;
(b) A schedule to application to transfer on which is set out the entire legal description of the parcel(s) in question. This schedule must also contain the names of the parties indicated on application to transfer; and
(c) A reference plan of survey, which bears the Land Registry Office registration number and signature as evidence of its deposit therein, illustrating the parcel(s) to which the consent approval relates; and/or a legal description of lands to be severed to which is acceptable to the land register.
2. That the easement be registered and shown on title for PIN 56012-0435 in favour of PIN 56012-0436.
3. The Ministry of Municipal Affairs and Housing is to be advised in writing by the transferor that the Offer of Purchase and Sale agreement, or alternatively an acknowledgement by the transferor and transferees if the transaction is between family members, contains the following clauses:
(a) That Prospective buyers or transferees be notified by the property owners that the Province of Ontario does not guarantee road access to the property and that private owners who rely on this road for access may need to assume costs and responsibility for upkeep and maintenance of this roadway (Taylor's Road).
(b) That the shoreline of the subject property is susceptible to flooding; the Crown reserves the right to flood and overflow lands on the subject property to a contour elevation of 1113.61 feet (339.4 metres) Geodetic Survey of Canada Datum.
(c) That the Province of Ontario will not support any further expansion onto Crown Land.
The last date to appeal this decision is October 17, 2022.

Proposal details
The purpose of this application is to provide an easement road for access purposes. The easement is intended to be conveyed from the South Lot (Lot 2 or Registered Plan SM-250) to the adjacent property on the North Lot (Lots 1,3 and Block A of Registered Plan SM-250) for the purpose of providing access to the tourist resort. The proposed easement would have a frontage of 6.0 metres, a depth of 56.10 metres and an area of 0.03 hectares.
This road access easement application is being processed in conjunction with application 59-C-220241 (under ERO No. 019-5789), which is a consent for a lot addition.
The subject lands are located approximately 27 kilometres northeast of the municipal boundary of the Town of Fort Frances. Access to the subject lands is by Taylors Road, a private road through Crown Land. The subject lands are approximately 400 metres from Highway 11 and 250 metres west of Bear's Pass bridge.
