Decision details

54-C-195426 was approved on December 2, 2021 with conditions. The application would sever approximately 59.77 hectares from the north ½ of Lot 7, Concession 4 (PIN 61286-0020), to be consolidated with the north ½ of Lot 8, Concession 4. The proposed consolidated lot would be approximately 123.39 hectares, is currently vacant and used for agriculture and would continue to be used as such. A lot approximately 4.04 hectares in size would be retained. The retained lot contains a dwelling, shed, barn, and two grain storage bins. The retained lot is currently used for residential use and would continue to be used as such. The consolidated and retained lots would be accessed from Long Lake Road via existing driveways.

The application was reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, water quality protection). No public comments were received or concerns identified.

Potential for water quality concerns related to existing services (septic system) on the retained lot will be addressed by non-standard “condition 4” listed below. No other concerns related to fish or wildlife habitat, water quality or quantity, species at risk, or protected areas were identified in relation to this application. There is an existing agricultural use on the consolidated parcel and no new buildings or structures are proposed for either the consolidated or retained lot.

The decision to approve the consent is consistent with the Provincial Policy Statement, this decision will not have an impact on the environment.

The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before December 22, 2021.

The applicants have one (1) year to satisfy conditions, otherwise approval will lapse.

Non-standard “condition 4”:

  1. That prior to final approval, the ministry must be advised in writing by the Timiskaming Health Unit that the retained lands have been inspected and that the existing sewage system meets their requirements.
