Decision details

Stelco Inc. revised their plans for the site during the technical review of the application. The revised project is for approval of the use of a single tank within the site's wastewater treatment facility to store liquid industrial waste, specifically process wastewater from other industrial generators in the City of Hamilton (RainCarbon and Stelco's Lake Erie Works).

The wastewater, which is similar is chemical composition to Stelco's own wastewater, will then be treated in the on-site wastewater treatment facility and ultimately discharged to the sanitary sewer in accordance with the sewer use agreement with the City of Hamilton.

The design of the storage tank was reviewed by the ministry to ensure it adheres to the ministry's guidelines on chemical and waste storage and financial assurance has been provided for the capacity of waste which can be stored at the Site.

The existing wastewater treatment facility and chemical analysis of the wastewater proposed to be received was also assessed to ensure that the wastewater will be treated in an environmentally protective and appropriate manner. The Environmental Compliance Approval contains other terms and conditions which have been imposed to ensure adequate environmental protection during the approved waste management operations.

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  2. could the decision you wish to appeal result in significant harm to the environment?

This proposal is for a new Environmental Compliance Approval (ECA) (waste disposal site) with Limited Operational Flexibility (LOF) for an existing waste transfer and processing facility operating under temporary authorization, located at 386 Wilcox Street, Hamilton, Ontario.

LOF for a waste disposal site provides a company with flexibility to make changes to defined aspects of the site’s operations without a requirement to make an application for amendment. It includes conditions that describe the scope within which the changes can be made. It allows industry to plan and to make changes to their facilities in a timely manner and reduce the delays associated with the traditional approvals process.

LOF incorporates additional conditions to ensure that the ministry is kept informed of the continued site operations, that the company remains in compliance with legislative requirements and that the environment is not adversely affected. The extent to which operational flexibility is permitted by the ECA for a waste disposal site is contained within an Engineer’s Report provided by the proponent.

This proposal is for the continued use and operation of an existing waste disposal site operating 24 hours per day, 7 days per week, serving the Province of Ontario. The facility is used for the following:

  • the temporary storage and processing of waste tar materials and discharge to the Hamilton sewer system under the Sewer Use By-law
  • the waste disposal site (wastewater treatment facility) may receive up to 1,250 cubic metres of liquid waste per day (625 cubic metres of liquid hazardous and 625 cubic metres of liquid industrial).
  • the temporary storage of materials at the site will be limited to 18,800 cubic metres of liquid waste and 450 tonnes of solid waste
  • the typical residual waste disposal quantity is 5 tonnes per day with an annual maximum of 1,800 tonnes

The Engineer's Report also allows for modifications to site equipment under the LOF of the ECA, including:

  • modifications or repairs to the facility including walls, floors, pits, roof, doors, plumbing, electrical etc.
  • addition or replacement of equipment for use on the site
  • the installation or replacement of transfer/processing equipment
  • modification or relocation of processing equipment and/or maintenance operations inside the facility footprint

The following modifications to the waste disposal site are not permitted under the proposal:

  • the ability to extend the physical size of the waste disposal site (i.e. add property)
  • the ability to change the type of waste that can be received at the site
  • the ability to increase the maximum rate of materials that may be received
  • the ability to increase the total mass of material stored at the site
  • any modification to the waste disposal site that requires a change to the Engineer’s Report
  • any modification to the waste disposal site that is subject to the Environmental Assessment Act
