Decision details

We have reissued Environmental Compliance Approval A650046 for a waste disposal site (transfer/processing) with a total area of 1.60 hectare located at 1731 Pettit Road, Fort Erie, Ontario. The facility has been non-operational since 2015, but the new owner is planning to restart transfer and processing operations.

The site is approved to receive, transfer and process liquid industrial, hazardous (Ontario Waste Classes 111, 112, 113,114, 121, 122, 123, 131, 132, 133, 134, 135, 142, 143, 144, 145, 146, 148, 149, 150 , 211, 212, 213, 221, 222, 251, 252, 253, 254, 261, 263, 267, 270 and 331) and non-hazardous solid wastes.

The site is approved to operate 24 hours per day, 365 days per week.

During the review of the application, the name of the owner changed from Revolution Environmental Solutions Acquisition GP Inc. The Environmental Compliance Approval is now issued in the name of GFL Environmental Services Inc.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Proposal details

This proposal is for an amendment to existing Environmental Compliance Approval (waste disposal site) No. A650046 for a waste disposal site (transfer/processing), with a total area of 1.60 hectares, located at 1731 Pettit Road, Fort Erie, Ontario.

The facility has been non-operational since 2015 (although, the ECA has been maintained), but with approval of this application will restart transfer and processing operations.

Approval is currently being sought for the addition of:

  • receipt of waste classes 145, 211, 212, 213, 221, 222, 251, 252, 253, 254, 261, 263, 267, 270, 331 as well as non-hazardous solid domestic waste and domestic recyclables
  • additional storage of 100, 205-litre drums of liquid and solid hazardous and non-hazardous waste
  • additional storage of 85,000 litres of non-hazardous liquid waste in indoor storage tanks
  • additional outdoor storage of 150 cubic yards of solid non-hazardous domestic waste and recyclable materials
  • storage of hydro-excavation waste in two onsite mixing cells
  • use of four existing indoor tanks (total capacity of 100,000 litres) for storage of virgin sodium hydroxide (all proposed changes are detailed in the application and Design and Operations Report)

The Fort Erie Facility operates 24 hours per day 365 days per year, and serves Canada, Mexico, South America and the United States.
