Decision details

This application to sever the property composed of PIN 56032-0092 and PIN 56032-0152 (shoreline allowance) from PIN 56032-0120 and PIN 56032-0151 (shoreline allowance) has been approved subject to the following conditions:

  1. That prior to final approval, the Ministry must be advised in writing by the Northwestern Health Unit that each the severed and retained lands have been inspected and are suitable for the installation of a subsurface sewage system, or that existing systems meet their requirements.
  2. That prior to final approval, written confirmation is received which states that there is adequate capacity to dispose of hauled sewage generated by the severed and retained lands. This written confirmation should take the form of a letter from the holder of an Environmental Compliance Approval (ECA) for an approved septage disposal facility, referencing the disposal facility and the related Ministry of Environment, Conservation and Parks (MECP) approval, and confirming that the disposal facility has sufficient reserve capacity to accept hauled sewage from the lots.

The last day of appeal is May 16, 2021.

Proposal details

The Ministry has received application 59-C-134607 for the creation of a new lot to rectify an inadvertent merger on title. The purpose of the application is to sever the property composed of PIN 56032-0092 and PIN 56032-0152 (shoreline allowance) from PIN 56032-0120 and PIN 56032-015 1(shoreline allowance). The proposed severed lot would be 0.43 hectares with 19.65 metres of lake frontage and 147.75 metres of depth, and the proposed retained lot would be 0.42 hectares with 32.30 metres of frontage and 77.59 metres of depth. The effect of this application is to correct an inadvertent merger on title. The proposed retained lands have a cottage service by septic system and lake water, the proposed severed lands are currently vacant as a derelict cabin destroyed by storm has recently been removed, and a new building is proposed and will be serviced by individual onsite sewage and water systems. This property is on Burditt Lake, approximately 38 kilometres from the Township of Emo and access is by water only.
