Decision details

Amended ARA licence No. 623958 was approved by the Regional Director on October 6, 2021.

The amended licence removes Schedule B containing three (3) conditions related to the site plan, restrictions on the tonnage condition and a requirement to rehabilitate the site by a specified deadline.  The rationale for removing these conditions was that updates have taken place to both the site plan and the municipal by-law from which these conditions originated.

The tonnage condition for this licensed site is contained within Condition 14 of Schedule A and states that “no more than 20,000 tonnes of aggregate shall be removed from the quarry in any calendar year”.

Application has been made by Drain Bros. Excavating Limited to amend the licence to remove three (3) conditions on Schedule B that have either been replaced with a more authoritative instrument or have been removed from the original Municipal by-law that the conditions were originally derived from:

  1. A requirement to operate in accordance with a sketch from June 29, 2007 until such time as the site plan required under section 71(6) is approved. This condition no longer applies, as the Site Plan was approved on August 29, 2013.
  2. A condition that was set out in a Municipal by-law that only allows 9595 tonnes of material to be removed from the site, notwithstanding condition 14 in Schedule A that allows for no more than 20,000 tonnes of aggregate to be removed in any calendar year. The by-law was amended in 2009 to remove the tonnage condition in Schedule B.
  3. A condition that is set out in a Municipal by-law that the site is rehabilitated by August 30th, 2011. The by-law was amended in 2009 to remove this condition.

Public consultation opportunities

The proposal request for this licence is being circulated within the Ministry of Natural Resources and Forestry. Additionally, notification of this application has been forwarded to the landowner for this property, the Township of North Kawartha and the County of Peterborough, for comment.
