The approval includes:
1. Existing Sewage System #1
An existing on-site sewage system to serve:
- a bunkhouse (Building #1) with 46 workers
- an office(Building #2) with 10 employees
It is designed to treat sewage at a maximum daily flow of 9,975 litres/day, consisting of:
- two concrete septic tanks, each with a capacity of 13,600 litres
- four raised filter beds, each rated at 2,494 litres/day and 50 square metres in size
2. Existing Sewage System #2
An existing on-site sewage system to serve a bunkhouse (Building #3) with 30 workers, designed to treat sewage at a maximum daily flow of 6,000 litres/day, consisting of:
- one concrete septic tank with a capacity of 13,650 litres, equipped with one effluent filter on the outlet
- one absorption trench leaching bed rated for 6,000 litres/day
3. New Sewage System
A new sewage system to replace the old sewage systems #3 and #4, servicing four bunkhouses (Buildings #4 - #7) with current 80 workers, 10 employees with shower access, and future 63 occupancies.
It is designed to treat sewage at a maximum daily flow of 30,000 litres/day, consisting of:
- one new concrete septic tank with a capacity of 6,800 litres, equipped with one effluent filter on the outlet and one 675 litres pump chamber, receiving sewage from Building #4 with occupancy of 12 workers
- one new concrete septic tank with a capacity of 29,500 litres, equipped with one effluent filter on the outlet and one 1,800 litres pump chamber, receiving sewage from:
- Building #5 with occupancy of 38 workers
- Building #6 with occupancy of 30 workers
- one new concrete septic tank with a capacity of 4,500 litres, equipped with one effluent filter on the outlet and one 675 litres pump chamber, receiving sewage from Building #7 with future maximum occupancy of 11 workers
- one new concrete septic tank with a capacity of 29,500 litres, equipped with one effluent filter on the outlet, receiving sewage from five trailers with future maximum occupancy of 52 workers
- one new 15,900 litres main pump chamber, equipped with three pumps rated 100 litres/minute at 4 metres TDH and an alternating demand triplex control panel, discharging via a 50 millimetres OD forcemain to the absorption trench leaching beds
- six absorption trench leaching beds, each rated for 5,000 litres/day (total of 30,000 litres/day)

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see

What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice

Proposal details
This proposal is for a new Environmental Compliance Approval (sewage) for Schuyler Farms Limited, for the establishment of subsurface disposal works to service a family farming operation producing apples, sour cherries, grains, oil seeds and grass-fed lamb located in Norfolk County between Simcoe and Waterford, Ontario.
The existing buildings on the main farm property include seven bunkhouses for seasonal workers, a main office building, and four warehouse/shop buildings. All buildings on the farm are supplied with private well water and septic systems. There are currently four septic systems installed and operating on the main farm property.
Future development of the farm includes building another bunkhouse for 200+ seasonal workers with an appropriately sized septic system. The daily design sanitary sewage flow is approximately 46,000 litres per day.
