The new Official Plan for the Municipality of Shuniah as adopted by By-law 3134-20 on October 13, 2020 was approved subject to ten(10) modifications on March 26, 2021.
Ten(10) modifications were required to ensure that the Official Plan has regard for Provincial Interests as set out in Section 2 of the Planning Act and to ensure consistency with the Provincial Policy Statement, 2020 (PPS). The new Official Plan provides appropriate localized policy direction for the protection and conservation of natural heritage features and areas and for the wise management of natural resources.
Of the ten (10) modifications, two (2) are specifically related to the environment:
- ensuring coastal wetlands are included in the protection given to natural heritage features in the protected area designation in the official plan (PPS 2.1);
- requiring new lots to be a minimum of 1 hectare unless a study demonstrates that private services can be provided on a smaller lot with no negative environmental impacts, and requiring a hydrogeological report where five (5) or more lots are proposed on private services to ensure there will be no negative environmental impacts (PPS 1.6.6).
Other information
Pursuant to Section 17(36.5) of the Planning Act, the Minister’s decision is final and not subject to appeal.

Proposal details
The Council of the Municipality of Shuniah adopted the proposed official plan on October 13, 2020 by By-law 3134-20. This proposed official plan is intended to update the policy framework that guides growth and physical (land use) change across the Municipality, while incorporating provincial objectives and community-driven priorities. The proposed official plan includes policies that consider the environment, such as restoration of brownfields, planning for sewage, water and waste, the provision of parks and open space, and protecting natural heritage. The proposed official plan is a result of the Municipality's review of the current official plan (approved in 1996), as required by the Planning Act.
The adopted official plan has been forwarded to the Ministry of Municipal Affairs and Housing by the Municipality of Shuniah for a decision. Pursuant to subsections 17(36.5) and (38.1) and subsection 21(3) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal. The proposed official plan, once approved, will replace the current official plan.
