An amended Environmental Compliance Approval (ECA) was issued to Jungbunzlauer Canada Inc. for approval of sewage works for the collection, transmission, treatment and disposal of process wastewater, once-through non-contact cooling water and stormwater runoff from the citric acid production facility (JBL Citric Plant) and the corn derived various sugar and food products manufacturing facility (JBL Glucose Plant).
The location is 1555 Elm Street, in the City of Port Colborne, Regional Municipality of Niagara, sewage works located within the JBL Citric Plant discharging to the Welland Canal and the JBL Glucose Plant (non-contact cooling water and stormwater emergency overflow) to the Old Welland Canal.
The amended ECA approved:
- re-rating of the Wastewater Treatment Plant from the average daily treatment capacity of 15,300 cubic meters per day to 20,400 cubic meters per day with the peak treatment capacity increase from 18,000 cubic meters per day to 24,000 cubic meters per day
- increase of once-through non-contact cooling water discharge from the existing maximum discharge rate of 163,440 cubic meters per day to 233,500 cubic meters per day
- one upgraded flow diffuser located at the end of the 1,050 millimetre diameter combined effluent discharge pipe discharging to the Welland Canal
- one existing holding lagoon (North Lagoon)
- one existing treatment lagoon (South Lagoon)
- one existing secondary clarifier
- one existing gravity sludge thickener tank
- one (1) upgraded wastewater treatment system lift station receiving effluent from the secondary clarifier, the North Lagoon, the South Lagoon and a stormwater management pond, consisting of a dry-well located within the pump house located east of the North Lagoon
- the removal of the existing temperature buoy from the Welland Canal

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:

- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?

This proposal is to amend Environmental Compliance Approval (ECA) No. 8452-AGGKU4, issued to Jungbunzlauer Canada Inc., for approval of sewage works serving the citric acid production facility (JBL Citric Plant) and the corn-derived glucose manufacturing facility (JBL Glucose Plant), located at 1555 Elm Street in the City of Port Colborne, Regional Municipality of Niagara.
The previously approved sewage works were designed for the collection, transmission, treatment, and disposal of process wastewater and once-through non-contact cooling water from the JBL Citric and JBL Glucose Plants and stormwater runoff the JBL Glucose Plant site. The approved sewage works located within the JBL Citric Plant discharge to Welland Canal, and within the JBL Glucose Plant discharge to the Old Welland Canal.
The proposed amendment application is for the approval of upgrades to the existing sewage works to accommodate an increase in production at the JBL Citric and JBL Glucose Plants to meet market demands. The proposed amendments are for approval of:
- an increase of once-through non-contact cooling water discharge from the JBL Citric and JBL Glucose Plants from the existing maximum discharge rate of 163,440 cubic metres per day to 233,500 cubic metres per day
- an increase of treated process wastewater discharge from the JBL Citric and JBL Glucose Plants from the existing maximum discharge rate of 18,000 cubic metres per day to 24,000 cubic metres per day
- a replacement of the existing 4-nozzle discharge diffuser system to a 6-nozzle discharge diffuser system
- the removal of the existing temperature buoy from the Welland Canal
