We issued an Environmental Compliance Approval to GFL Environmental Inc. for an increase in daily tonnage at their existing waste processing site in Dorchester, Ontario, used for the treatment of excess soil.
The amount of excess soil that may be received at the site has been increased from 1300 to 5000 tonnes per day, with a corresponding increase in truck traffic from 20 to 50 trucks per hour.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:

- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision

- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see

What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

Note: This notice was initially posted on August 17, 2020 for 45 days comment period. On January 8th, 2021 the ministry updated this environmental registry notice to include new information. This notice is being posted for another 45 day period consultation.
This proposal is for the amendment of the Environmental Compliance Approval (ECA) No. 8096-8UEJJJ for GFL Environmental Inc. for the operation of an ex situ biological treatment facility for non-hazardous petroleum hydrocarbon and volatile organic compound impacted soils at 600 Hudson Drive, Dorchester, Ontario. This Site operates on a 5.72 hectare site within a 9.56 hectare total site area. The Site will only receive contaminated soil for bioremediation that (a) contain petroleum hydrocarbons that can be biodegraded which includes Fractions F1 to F4, semi-volatile organic compounds (SVOCs) and volatile organic compounds (VOCs) excluding chlorinated solvents and (b) does not contain non-biodegradable contaminants at concentrations exceeding the applicable quality criteria for reuse at the final destination.
The proposed amendment includes:
- an increase in the amount of contaminated soil received to 5,000 tonnes per day
- an increase in the hourly trucking limit to 50 trucks per hour
- an increase in the annual tonnage received to 750,000 tonnes
The maximum capacity for waste soils in storage and processing at the Facility at any one time will remain the same and will not exceed 40,000 tonnes. The average amount of waste soils that is received at the Facility for treatment and/or transfer shall not exceed 750,000 tonnes per year. All waste soils are stored and processed on asphalt surfaces.
There is no change to the hours of operation. Receiving hours of operation will be Monday through Friday 7:00 am to 7:00 pm and Saturdays 7:00 am to 3:00 pm. Processing activities (screening and soil movement) will be restricted to Monday through Friday 7:00 am to 5:00 pm and Saturdays 7:00 am to 3:00 pm.
