Bulletin summary

We have approved a new Environmental Compliance Approval No. 0206-BQN2YC to Kingslea Developments Limited for the establishment of stormwater management works for the proposed light industrial development, located at 131 Ellis Drive, in City of Barrie, Ontario.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin as because the proposal was posted on May 4, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1736 for public comment from May 4, 2020 - June 18, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details

Stormwater management works is proposed for the collection, treatment and disposal of stormwater run-off from catchment areas within the 1.27 ha site to provide Enhanced Level water quality control, discharging via a City-owned swale to an existing municipal wet pond (Pond LV-02) located on a site east of Welham Road for quantity control and additional quality control, consisting of the following:

  • one oil and grit separator for quality control
  • one dry pond for quality control
  • subsurface infiltration system for roof runoff
  • quantity control and additional quality control will be provided by municipal wet pond located offsite

Effects of consultation

Comments were received and reviewed, and, where appropriate, were considered in the design of sewage works by the consultant and in the ministry’s decision whether or not to proceed with this proposal. Conditions were also imposed to the approval according to the received comments.

Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect. On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak which exempts all proposals from the requirement to post notices on the ERO. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
