Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin as because the proposal was posted on May 20, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consulted with the public on this proposal by posting ERO# 019-1800 for public comment from May 20, 2020 - July 4, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details
The director issued the order to the former owners of 152/153 Shanley Street, Kitchener on July 21, 2020.
A summary of the key requirements of the order includes, but are not limited to, the following:
- Retain a competent and qualified consultant(s) to prepare and complete the work specified in the order.
- Submit monthly written status reports to the director.
- Complete an evaluation of the existing off-site groundwater monitoring well network along with the existing soil vapour probes.
- Submit to the director a proposed plan to to upgrade, replace and/or abandon the monitors/probes as necessary as well as a proposed groundwater, soil vapour and residential indoor air monitoring program.
- Upon approval from the director, implement the proposed work plan and monitoring programs.
- Submit to the director annual and biannual reports as required.
- Prepare and submit to the director a proposed remedial action plan.

- preventive measures (Section 18)
- orders, consequential authority (Section 196(1))

No comments were received during the consultation period.
Effects of consultation
No comments were received as a result of the consultation process and no changes were made by the director prior to issuing the order.
Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect.
