Decision details

An Environmental Compliance Approval with Limited Operational Flexibility was issued to amend all previous Environmental Compliance Approvals (air & noise) for Lafarge Canada Inc., a portland cement manufacturing facility located in (Bath) Loyalist, Ontario.

The amendments include the following:

  • installation of equipment for the use of hot fluid coke as kiln fuel
  • installation of Non-Catalytic Reduction (SNCR) for control of nitrogen oxides from the cement kiln
  • updating information on source parameters of previously approved emission sources
  • inclusion of limited operational flexibility for all sources at the facility

The major emission source groups at the facility that discharge to the air include:

  • raw material delivery, storage, crushing and transfers
  • conventional fuel preparation and storage
  • low carbon fuel preparation and storage
  • clinker production in cement kiln and clinker storage
  • cement production and storage
  • packing and dispatch
  • ancillary and support operations such as heating and cooling and maintenance operations

Emissions to the air from this facility include:

  • suspended particulate matter
  • silica
  • calcium
  • metals such as manganese and nickel
  • volatile organic compounds
  • products of combustion such as nitrogen oxides and sulphur dioxide

The Environmental Compliance Approval (Air) with Limited Operational Flexibility requires that the company demonstrates compliance on an ongoing basis with Ontario Regulation 419/05, applicable ministry guidelines for air and noise and other performance requirements as specified in their conditions. It permits modifications such as process changes, de-bottlenecking or addition of new equipment, subject to limits on operational flexibility, that include a production limit for the facility specified in the approval.

The limited operational flexibility conditions have a ten years expiry date. The company is required to make an application for amendment at that time to renew these conditions. Of specific public interest, one condition that is included in the approval requires the company to make available, at all times, at the facility for inspection by interested members of the public a table (Emission Summary Table) that documents the facility’s compliance with Ontario Regulation 419/05.

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  • volatile organic compounds
  • products of combustion such as nitrogen oxides and sulphur dioxide

The Environmental Compliance Approval with Limited Operational Flexibility (Air & Noise), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air & Noise).

The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.
