This proposal notice has been updated on March 14, 2023 to advise the public that this application is still under active review. The ministry is reviewing the comments it has received to date. The original proposal date and comment period have not been altered. This notice was originally published on April 22, 2020 for 45 days comment period. It was updated on July 20, 2021 to provide an additional 45 days comment period but stated incorrectly that normal public consultation requirements under EBR did not apply. The notice was updated on March 22, 2022 to correct this error.

Approval is granted for an amendment to Environmental Compliance Approval No. 1175-AX8JRZ with Limited Operational Flexibility (air), which replaces all the current Environmental Compliance Approvals for air at this facility and includes the addition of new, or historically unapproved, sources for all emissions from Innocon Inc., a ready mix concrete batching plant and aggregate depot located in the City of Richmond Hill, Ontario.

The emission sources from the manufacturing and associated processes that exhaust to the air include:

  • aggregate receiving, storage, and transfer
  • cementitious materials receiving and storage
  • concrete production and shipping
  • processing heating
  • emissions from the aggregate depot operations including aggregate material storage, handling and shipping

This amendment is for the addition of a tow compartment cement silo with two associated dust collectors.

Contaminant emissions to the atmosphere include:

  • particulate matter
  • calcium carbonate
  • magnesium carbonate
  • Portland cement slag
  • nitrogen oxides
  • other products of combustion

The Environmental Compliance Approval with Limited Operational Flexibility (air), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (air).

The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal
