Decision on instrument

The new Official Plan for the Town of Bruce Mines, adopted by By-law 2019-43 on December 16, 2019 was approved as modified on May 28, 2020. The modifications were required to ensure that the Official Plan has regard for Provincial Interests as set out in Section 2 of the Planning Act and to ensure consistency with the Provincial Policy Statement, 2020 (PPS).

Major themes for the 14 modifications include:

  • clarifying Planning Act requirements regarding Official Plan review and inclusionary zoning (Planning Act);
  • ensuring adequate separation between incompatible uses in order to protect public health and safety (PPS 1.2.6);
  • ensuring the protection of provincial highway corridors to avoid, mitigate or minimize negative impacts on and from the corridor and transportation facilities (PPS 1.6.8.3);
  • restricting development in or adjacent to natural heritage features to protect the natural environment (PPS 2.1);
  • ensuring the conservation of significant archaeological resources in order to protect the Province’s cultural heritage (PPS 2.6); and,
  • restricting development in natural or human made hazardous areas to protect public safety and development from the risks associated with natural and human made hazards (PPS 3.1).

Other information

Pursuant to Section 17(36.5) of the Planning Act, the Minister’s decision is final and not subject to appeal.

Details of instrument

The Council of the Town of Bruce Mines adopted the proposed official plan on December 16, 2019 by By-law 2019-43. This plan is intended to update the policy framework that guides growth and physical (land use) change across the Town, while incorporating provincial objectives and community-driven priorities. The proposed official plan is a result of the Town’s 10-year review of the current plan, as required by the Planning Act. The current official plan was approved in 2013.

Other information

The adopted official plan has been forwarded to the Ministry of Municipal Affairs and Housing by the Town of Bruce Mines for a decision. Pursuant to subsections 17(36.5) and (38.1) and subsection 21(3) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding an official plan adopted in accordance with section 26 is final and not subject to appeal.
