Decision details

54-C-175406 was approved on November 6, 2018 with conditions. The new rural residential lot would be 2 hectares in size with 120 metres of frontage on Vahey Road and a depth of 170 metres. The retained lot would be an irregularly shaped lot approximately 86 hectares in size and is used for agricultural purposes. Both the proposed severed and retained lot were vacant when provisional consent was granted.

The conditions of provisional consent were not met within one (1) year, therefore draft approval lapsed on November 6, 2019.

Non-standard conditions included:

  1. The Ministry of Municipal Affairs and Housing receive written confirmation from:
  • The Township of Harris that Restricted Area By-law No. 506 (known as the Harris Township Zoning By-law) has been amended to prohibit site alteration and development within 50 metres of the Dawson Point Area of Natural and Scientific interest as identified by the Ministry of Natural Resources and Forestry on the lands subject to consent application 54-C-175416, or from:
  • The Ministry of Natural Resources and Forestry (MNRF) that a study has demonstrated that a lesser setback than 50 metres from the ANSI is necessary and from the Township of Harris that Restricted Area By-law No. 506 (known as the Harris Township Zoning By-law) has been amended to prohibit site alteration and development within the identified setback as defined by the above noted study, on the lands subject to consent application 54-C-175416.
  1. That prior to final approval, the Ministry must be provided written confirmation of adequate capacity to dispose of hauled sewage generated by the proposed new lots. This written confirmation should take the form of a letter from the holder of an Environmental Compliance Approval (ECA) for an approved septage disposal facility, confirming it has sufficient reserve capacity to accept any additional hauled sewage from these lots.
     
  2. This Ministry is to be advised in writing by the transferor that the Offer of Purchase and Sale agreement, or alternatively an acknowledgement by the transferor and transferees if the transaction is between family members, contains the following clause:
  • No assessment has been undertaken for groundwater quality or quantity. Groundwater supplies may not be adequate to support the use of individual private wells.
  • Should wells be considered as drinking water sources, they must be constructed in accordance with Regulation 903 - Wells, under the Ontario Water Resources Act.
  • Small private sewage disposal facilities which have a daily sewage flow of 10,000 litres or less per day must be certified by the Temiskaming Health Unit. Large private sewage disposal facilities which have a daily sewage flow of >10,000 litres, or communal systems, must be approved by the Ministry of the Environment. The Temiskaming Health Unit should be contacted for information on the proper installation and operation of Class IV septic systems and Class I (pit privy) sewage systems.
  • Domestic waste must be appropriately handled and disposed of at an approved waste disposal facility.

The severed lot would be approximately 2 hectares with 120 metres of frontage onto Vahey Road and a depth of 170 metres. The retained lot would be an irregularly shaped lot approximately 86 hectares in size and is currently used for agricultural purposes. Both lots are currently vacant.
