Decision background
On October 1, 2018, the licensee requested a hearing before the Local Planning Appeal Tribunal (LPAT). On January 21, 2019, MNRF and the licensee engaged in Tribunal assisted mediation and reached a settlement.

On June 11, 2019, the LPAT directed the MNRF to amend the plan in accordance with the settlement.
As per direction from the LPAT, the site plan was amended to reflect a licensed area of 27.3 hectares (ha), reduced setbacks creating a new extraction area of 25.9 ha, add two internal entrance/exists, allow for 2:1 slopes for final rehabilitation, and allow importation of fill for the purpose of rehabilitation.
Minor amendments previously approved in 2003 were also added to the site plan including notes regarding recycling of asphalt and concrete, scrap storage, a spills action plan and portable fuel tank. The disturbed area outside of the licensed area is to be rehabilitated.
Effects of consultation
No comments were received in response to the Environmental Registry notice.
MNRF sought comment from the local and regional municipality regarding the proposed LPAT settlement. Both municipalities indicated that they have no concern with the proposed settlement.
MNRF has approved the amended site plans as per direction from the LPAT.

Description of instrument
The Ministry of Natural Resources and Forestry issued Licence #5051 for a Class A pit on a site of 27.3 hectares in size. The approved site plan for this licence indicates an extraction area of 21.2 hectares (ha) to be extracted in four (4) phases. This approval is consistent with the application that was submitted under the Aggregate Resources Actand the approved zoning by-law at the time of the Aggregate Resources Act application.
Amendments to the Operation page of the Site Plan (Operations Plan) for this licence were approved by the Ministry in April 1998 and in July 2003. In 2016, the Ministry of Natural Resources and Forestry became aware that the licensee was operating in areas that the Ministry of Natural Resources and Forestry considers to be within the extraction setback and outside of the licenced boundary. On further review, the Ministry of Natural Resources and Forestry determined that the licensee was operating according to an Operations Plan that showed an increased licensed area and two additional extraction areas that were identified in error on the site plan. The Ministry of Natural Resources and Forestry is requiring that the licensee amend the Operations Plan to show the licensed site as 27.3 ha with an extraction area of 21.2 ha and four (4) phases, as originally approved at the time of licensing, and include the minor amendments approved by the Ministry of Natural Resources and Forestry on June 12, 2003. These amendments pertain to location and notes regarding recycling of asphalt and concrete, scrap storage, spills action plan and portable fuel tank.
