Decision details
Aggregate Resources Act licence No. 626157 was issued on February 22, 2022 to Nadin Contracting Ltd, subject to conditions specified on Schedule A and B.
The licensed area is 74.25 hectares in size and allows extraction of aggregate from a pit above the water table. The tonnage condition allows 100,000 tonnes of aggregate to be removed from the site in any calendar year.

Effects of consultation
Zero (0) comments were received in response to the Environmental Registry of Ontario notice.
Forty-six (46) objections were received in response to the ARA consultation process related to:
- protection of the natural environment (species at risk, wildlife habitat, wetlands)
- water quality
- public safety
- traffic and road degradation
- loss of farmland
- aggregate fees
- alternative aggregate supplies available
- noise
- dust and air quality
- land use compatibility
- property values
The applicant worked to address the objections by providing additional information and revising the site plan.
There were fifteen (15) outstanding objections at the end of the application process. The application was referred to the Ontario Land Tribunal (OLT) for a hearing. On September 24, 2021, the OLT directed the Minister of NDMNRF to issue the licence (OLT Case MM190006).

Proposal update
This notice was updated on March 31, 2021 to advise the public that there has been no change to the status of the proposal and it is still being considered. No additional opportunity for comment is being provided for at this time.
This notice was updated on April 16, 2019 to advise the public that this application under the Aggregate Resources Act has been referred by the Ministry of Natural Resources and Forestry to the Local Planning Appeal Tribunal for a hearing. Please refer to http://elto.gov.on.ca/tribunals/lpat/e-status/ for further information on the status of the matter at the Local Planning Appeal Tribunal.
Description of instrument
Application has been made by Nadin Contracting Ltd. for a Class “A” licence (Pit above Water) to excavate aggregate from a new pit of 74 hectares in size. The annual tonnage condition applied for is unlimited.

Site plan information is available to view at the Ministry of Natural Resources and Forestry Thunder Bay District office. Making an appointment to view the information is recommended to ensure aggregate staff will be available to provide information and answer questions.
Comments received through the Environmental Registry should not be construed as an objection under the Aggregate Resources Act in accordance with section 4.0 – Notification and Consultation Standards of the Provincial Standards 1.0 under the ARA. To be considered as a formal objector, individuals need to contact the MNRF person specified on this notice to determine how to submit an objection.
Other public consultation opportunities
As specified in the ARA written notice concerning this application was delivered to landowners within 120 meters of the proposed licenced boundary; an information sign, giving notice to the public of this application, was erected at the proposed site; and a Notice of Application appeared in the local paper, the Chronicle Journal on February 1, 2017. A public information session will be held on February 27, 2017 from 6 - 8 pm at 363 North Branch Road Fire Hall, Thunder Bay Ontario.
The application for this proposal is being circulated within the MNRF Thunder Bay District office. Additionally, notification of this application has been forwarded to the Lakehead Rural Planning Board and the Lakehead Region Conservation Authority.
