Description of instrument
Dumont Backhoe Services, the licensee and land owner, was issued a grandfathered Class “B” licence following the designation of Nipissing District on January 1, 2007. The licence is a Category 5 – pit (below water table) on a site of 34 hectares in size.
In July 2015, the North Bay Ministry of Natural Resources and Forestry office received a complaint reporting the extraction of aggregate in close proximity to an alleged water course causing discolouration to the water and a reduction of water flow. In the absence of the natural water feature on the site plan, an inspection was conducted at the site by the MNRF Area Biologist to investigate the reported occurrence. It has been determined that the subject watercourse is a natural intermittent stream.
Therefore, it is recommended that the intermittent stream discovered on site be protected by amending the site plan, in accordance with section 16. (1) of the Aggregate Resources Act. This amendment will require the licensee to include on the site plan the missing body of water (intermittent stream) with the applicable setback of 30 metres per Section 5.10.3 of the Aggregate Resources Act Operational Standards as outlined in the Aggregate Resources of Ontario, Provincial Standards.
