Aggregate Resources Act Licence # 625739 was issued to Brian and Pearl Bumstead on October 22, 2020, subject to conditions specified on Schedule A (Prescribed Conditions) and B.

The licensed area is 39.6 hectares in size and allows the operation of a pit within 1.5 metres of the water table. The tonnage condition specifies a maximum of 150,000 tonnes of aggregate to be removed from the site in any calendar year.

Effects of consultation

Twelve (12) comments were received in response to the Environmental Registry notice. Thirty-three (33) letters of objection were received in response to the Aggregate Resources Act consultation process. The objections were related to noise, dust, health impacts, truck traffic, hours of operation, road safety, impacts to groundwater, and loss of property value. The applicant worked to address the objections by providing additional information and revising the site plan.

There were nineteen (19) outstanding objections at the end of the Aggregate Resources Act process. The application was referred to the Local Planning and Appeal Tribunal (LPAT) for a decision. A hearing was held August 12-16, 2019 and the Tribunal has directed the Minister to issue the licence (LPAT Case No. PL171090).

This notice was updated on July 18, 2019 to advise the public that this application under the Aggregate Resources Act has been referred by the Ministry of Natural Resources and Forestry to the Local Planning Appeal Tribunal.  Please refer to http://elto.gov.on.ca/tribunals/lpat/e-status/ for information on scheduled hearings of the Local Planning Appeal Tribunal.

 

Description of instrument

Brian and Pearl Bumstead have applied for a Class “A” Pit to excavate aggregate within 1.5 meters of the water table on a pit that is 39.6 hectares in size. This application is for the establishment of a new pit. The annual tonnage condition applied for is 150,000 tonnes per calendar year.

Comments received through the Environmental Registry should not be construed as an objection under the ARA in accordance with section 4.0 – Notification and Consultation Standards of the Provincial Standards 1.0 under the ARA. To be considered as a formal objector, individuals need to contact the MNR person specified on this notice to determine how to submit an objection.

Other public consultation opportunities

As specified in the ARA, written notice concerning this application was delivered to landowners within 120 metres of the proposed licenced boundary; an information sign, giving notice to the public of this application, was erected at the proposed site; and a Notice of Application appeared in the local paper, Owen Sound Sun Times on December 20, 2013. A public information session was held on January 16, 2013 at 5:00 p.m. at the Williamsford Community Center, 112 Salter Street, Williamsford, ON.

The application for this proposal is being circulated within the MNR Midhurst District. Additionally, notification of this application has been forwarded to the Township of Chatsworth, County of Grey and the Saugeen Valley Conservation Authority for comment.
