We have issued an amendment to Environmental Compliance Approval (waste disposal site) No. 5762-6VLLYE for R&D Recycling (now GFL Environmental Inc.) for a solid non hazardous waste processing facility, located in the Unorganized Township of Commanda, Ontario.
R&D Recycling is operating a semi-automated non-hazardous solid waste material (e.g. plastic, metal, glass, fibers) recycling line with a total site area of 131.28 hectares.
We have approved the following changes at the facility:
- doubling the facility’s processing capacity from 40 to 80 tonnes daily
- doubling the maximum amount of residual waste transferred from the site from 2 to 4 tonnes daily
- doubling the amount of unprocessed waste, processed waste and residual waste stored at the facility at any time from 200 to 400 tonnes
- increase the maximum amount of processed waste stored on site at any one time from 200 to 400 tonnes
The existing process being used includes separation of materials with:
- an OCC screen
- a fiber screen
- an optical sorter
- a magnet
- eddy-current
Once the recyclables have been properly separated, they are accumulated before being baled and shipped out to different clients.
Nonrecyclables (residuals) are properly disposed to a certified/designated site. R&D Recycling operated the facility well below its sorting line capacity. Doubling the above capacities does not require any change to the process as it will utilize the process’ full capacity.
All operations, from reception to shipping, are inside the building and there is little to no dust generated during the operation, therefore no dust collector nor watering is required. All employees working stations are within enclosed cabins that are properly heated and ventilated.
The facility processes dry recyclables from municipalities from the North Bay area that are sold to brokers while the residuals are transported to licensed facilities to be disposed. The facility operates from:
- 7:00 a.m. to 8:00 p.m. Monday to Friday
- 7:00 a.m. to 4:00 p.m. Saturday
Note that the operating hours have remained the same even after doubling the above capacities.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
