We issued an Environmental Compliance Approval (ECA) No. 8014-CBRQ72 dated July 1, 2022, for a 11.21-hectare waste disposal site (processing/transfer) for receipt, temporary storage, processing and transfer of liquid organic wastes destined for land application on agricultural land as a non-agricultural source material (NASM).

The ECA approves a new use of three existing earthern, clay-lined lagoon cells.

The following waste management/processing activities are approved under this approval:

  • receipt and temporary storage of the approved waste in Cells 1 and 2
  • waste blending in Cells 1 and 2
  • waste mixing (stirring) in Cells 1 and 2
  • transfer of the waste to an approved NASM Plan Site for land application or to a site approved by the ministry for land application in non-agricultural setting, final disposal or further processing/treatment
  • transfer of the supernatant (wastewater component of the waste) between Cells 1, 2 and 3
  • mixing and treatment of the supernatant through aeration with 4-19 kW (kilowats) (25 hp (horsepower)) Aqua-Aerobic Systems Aqua-Jet high-speed floating surface aerators in Cell 3
  • transfer of the supernatant from Cell 3 to a ministry-approved site to receive the supernatant for final disposal or further processing/treatment

The site is approved to accept waste generated within the Province of Ontario in quantities that are not to exceed a maximum daily amount of 812 m3 per day.

The site is approved to be operated Monday through Saturday 7 a.m. to 9 p.m., except holidays, unless otherwise limited by municipal by-laws.

Discharge of the supernatant to the natural environment is not approved under this ECA.

This site was previously approved under the ECA (industrial sewage works) No. 6589-ASHNN5 dated November 9, 2017.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

Bartels Environmental Services Inc. is applying for an Environmental Compliance Approval for a waste disposal (transfer) site for a storage lagoon located in Part of Lot 13, Dublin in the Township of Hibbert, Municipality of West Perth, County of Perth, Ontario.

This site area is approximately 112,000 square metres. The lagoon, previously owned by Sofina Foods Inc., and known as the Sofina Wastewater Treatment Facility, was operated under the authority of amended Environmental Compliance Approval No. 6589-ASHNN5, issued on November 9, 2017.

On January 9, 2020, Bartels Environmental purchased the lagoon from Sofina with the intention of operating it as a waste disposal site (transfer).

The site will operate from 7am – 9pm, Monday through Saturday excepting Holidays. The site is to service the Province of Ontario.

Bartels Environmental intends to use the proposed outdoor lagoon site with three storage cells to temporarily store wastes. In addition, the Stratford Water Resource Recovery Facility needs an off-site storage area for its digestate. Bartels Environmental will partner with the City of Stratford to store their co-digested anaerobically treated digestate at the proposed lagoon site.

Types of waste that will be received on site from local municipalities, including the Stratford Water Resource Recovery Facility, will fall into the following Non-Agricultural Source Material categories:

  • Category 3, 11
  • Category 3, 5
  • Category 2, 3e

with the potential to receive Canadian Food Inspection Agency registered fertilizer products managed by Bartels Environmental, which would be considered Non-Agricultural Source Material with mixed storage at the site.
