The EACOM Gagoma wood waste disposal site no longer accepts waste for landfilling, and the disposed wood waste is being reclaimed. The site was scheduled to close by March 2021. To allow for continued wood waste reclamation, the ECA is amended to approve the following:
- remove the closure date stipulated in the ECA
- construction of a wood waste processing pad within the landfill footprint after the wood waste reclamation is completed

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to Environmental Compliance Approval no. 4596-6B8LBZ for EACOM Timber Corporation for the use and operation of a 5.7-hectare landfill (North and South Landfills) within a 35-hectare total site area located at Parcel 30-454SWS Parts 1 to 7, Westbrook Unorganized Township, District of Sudbury. The facility currently receives, transfers and processes wood waste, slag/ash, and soil. Ongoing wood waste reclamation has reduced size of the waste footprint at the site.
This amendment is to extend the operation of the landfill and to build a work pad from a portion of the existing wood waste. The pad would be a platform to process log deck and dirty bark, clean wood, slag/ash, bark, chips, shavings and sawdust. The work pad would be approximately 250 feet by 250 feet and be located in the existing footprint of the south landfill area. It is anticipated the pad would be constructed in 3-5 years or sooner.
The amendment is to void the closure date and maintain the area within the landfill footprint as a “Zero Waste Processing Pad”. The waste reclamation operation is described in the current ECA no. 4596-6B8LBZ, and the change to the operation is that material from the landfill that is suitable for use in constructing the work pad will be used for that purpose until the pad is completed. Upon completion of pad, reclamation and processing activities will continue, using the pad as location for these activities.
The usual hours of operation are from 6:00 am to 8:00 pm, and the site is to service the Province of Ontario.
