We have issued an Environmental Compliance Approval (sewage) to Carson Road Development Inc. for the establishment of storm sewers to service Phase 1A of Midhurst Carson Road - Mick's subdivision, located on a property legally described as Lot 14, Concession 6 in the Township of Springwater, County of Simcoe, Ontario.
The issued Environmental Compliance Approval (sewage) consists of the following:
- storm sewers on 'Street A' from southeast of 'Street B' to 'Street E', approximately 282 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street A' and 'Street E'
- storm sewers on 'Street A' from north of 'Street E' to north of 'Street B', approximately 179 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street A' and 'Street B' on northern side of the site
- storm sewers on 'Street A' from approximately 92 metres southeast of Snow Valley Road to northwest of Snow Valley Road, approximately 105 metres in length, discharging via headwall (HW2) to the ditch located northwest of Snow Valley Road
- storm sewers on 'Street B' from approximately 41 metres west of 'Street C' to 'Street A', approximately 860 metres in length, discharging to the proposed storm sewer located between the embankment and 'Street B' on the northwest corner of the site
- storm sewers on 'Street B' from 'Street H' to approximately 17 metres in length east of 'Street H', discharging to the proposed storm sewer located at the intersection of 'Street B' and 'Street H'
- storm sewers on 'Street C' from 'Street B' to 'Street E', approximately 275 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street C' and 'Street E'
- storm sewers on 'Street D' from approximately 42 metres west of 'Street A' to 'Street B', approximately 288 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street D' and 'Street B'
- storm sewers on 'Street E' from 'Street H' to 'Street B', approximately 421 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street E' and 'Street B'
- storm sewers on 'Street F' from approximately 13 metres northeast of 'Street B' to 'Street E', approximately 219 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street F' and 'Street E'
- storm sewers on 'Street G' from 'Street B' to 'Street E', approximately 278 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street G' and 'Street E'
- storm sewers on 'Street H' from 'Street B' and 'Street E', approximately 287 metres in length, discharging to the proposed storm sewer located at the intersection of 'Street H' and 'Street E'
- storm sewers on Block 295 from 'Street B' to approximately 77 metres in length west of 'Street B', discharging to the proposed stormwater management pond located on the northwest corner of the site

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for a new Environmental Compliance Approval (sewage) to be issued to Carson Road Development Inc. as part of the Midhurst Carson Road - Mick's Subdivision located on a property legally described as Lot 14, Concession 6 in the Township of Springwater, County of Simcoe, Ontario.
The sewage works will include new storm sewers designed to collect runoff from internal streets and lots from the site; discharging into the Willow Creek subwatershed through an existing stormwater management pond.
