An Environmental Compliance Approval (ECA) is granted to WeedMD RX Inc. for stormwater management works servicing an expanded greenhouse site located at 8157 Inadale Drive, in the Township of Strathroy-Caradoc.

The approved works include:

  1. Northern System, serving 4.16 ha of the property, and consists of an underground chamber system, a backup pond and parking lot surface storage with total storage volume of 2,889 cubic metres, discharging via a riser pipe into the Leitch Municipal Drain.
  2. Western System, serving 15.36 ha of the property, and consists of an oil/grit separator, a dry pond with storage volume of 9,306 cubic metres, discharging via a riser pipe outlet into the Glockner Municipal Drain.

In addition, it is also approved to construct a temporary dry pond serving 3.68 ha of area (constructing as part of Phase 1 development and operating only before the completion of the above mentioned underground chamber system), and consisting of grassed swales with a storage volume of 1,367m3, discharging via a riser pipe outlet for the minor system into Leitch Municipal Drain and via a weir for the major system into Inadale Drive roadside ditch.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

The project for which approval is being sought includes three (3) stormwater management (SWM) facilities to service a greenhouse facility. A temporary pond and two permanent facilities all to be located on the property at 8157 Inadale Drive in the Municipality of Strathroy-Caradoc.

The temporary dry pond will serve 3.68 hectares of area which includes approximately 2.14 hectares of impervious area. The facility will:

  • receive stormwater runoff from greenhouses roof-tops and hard surface areas including buildings roof-tops and driveways
  • receive the runoff from a SWM system including pipes and grassed swales
  • have a storage volume of 1,367 cubic meters
  • have a weir for relief during major system discharge and a riser pipe outlet for the minor system that will discharge to the Leitch Municipal Drain and be conveyed to the Inadale Drive ditch through the weir

The northerly permanent facility will serve 4.16 hectares of the property that is tributary to the Leitch Municipal Drain. The facility will consist of an underground chamber system, a backup pond and parking lot surface storage. The facility will:

  • receive stormwater runoff from greenhouses (roof-top)
  • receive the runoff from a SWM system including pipes, grassed swales and directly tributary surfaces including the parking lot and backup pond surface area
  • have a total storage volume of 2,831 cubic meters, for the 100 year storm event the maximum storage is 2,415 cubic meters;
  • have a riser pipe discharging to the Leitch Municipal Drain
  • provide quality control using the isolator row of the underground chamber system and have a minimum TSS removal rate is 84%

The westerly permanent facility will serve 15.36 hectares of the property that is tributary to the Glockner Municipal Drain. The dry pond will:

  • receive stormwater runoff from greenhouses roof-tops and additional hard surface areas including building roof-tops and driveways
  • receive the runoff from a SWM system including pipes, channel, and sheet flow off of the driving area
  • have a storage volume of 9,306 cibic meters
  • have a riser pipe outlet discharging to the Glockner Municipal Drain
  • provide quality control using a downstream oil grit separator with a 78% annual TSS removal
