An amended Environmental Compliance Approval was granted to LK Aurora Inc. for an for the establishment of sewage works for the treatment and subsurface disposal of sanitary sewage, with a total rated capacity of 34,400 L/d, servicing a new commercial development located in the Town of Whitchurch-Stouffville, Regional Municipality of York.
The new commercial development will consist of 10 retail stores, doctor's/medical offices and five 10-seat restaurants located within Commercial Building "A" and one 58-seat restaurant located within Commercial Building "B". The approved sewage works consist of:
- one pumping station
- four 4,500 L three-compartment grease interceptors
- one 27,500 L one-compartment flow equalization tank
- one 69,400 L two-compartment sludge storage/primary clarifier tank
- a moving bed biofilm reactor (MBBR) tertiary treatment system consisting of two 22,730 L one-compartment moving bed biofilm bioreactors, one 27,500 L one-compartment intermediate clarifier tank and one 27,500 L two-compartment secondary clarifier/intermediate pump tank
- a passive single-pass filter system consisting of one 68,200 L one-compartment Nitrex Filter tank
- a final polishing treatment unit consisting of one 15,900 L two-compartment moving bed biofilm bioreactor (Bioreactor # 3)/tertiary clarifier tank, provisions for a future sand filter (equivalent to Parkson Ecowash sand filter tank), one 9,000 L one-compartment concrete final effluent pumping station and an underground Type A dispersal bed

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is to amend the existing Environmental Compliance Approval (ECA) No. 1109-BBRQJ2 that was issued on May 29, 2019 for the approval of sewage works at the LK Aurora site, Part of Lot 21, Concession 8, Town of Whitchurch-Stouffville, Ontario. The sewage works that were previously approved are rated for 26,921 L/day and consist of:
- pretreatment system, consisting of:
- two (2) grease interceptors in Commercial building “A”
- one (1) 18,150 liter flow equalization tank
- primary treatment system, consisting of one (1) 27,320 liter sludge storage/primary clarification tank
- secondary treatment system, consisting of a WSB Clean Pro Sewage Treatment Plant
- denitrification system, consisting of:
- two (2) nitrex filters
- one (1) final polishing bioreactor
- contingency denitrification system, consisting of a Parkson Ecowash DSF7BTF
- one (1) 6,800 liter final effluent pumping tank
- subsurface disposal system consisting of an area bed with a total area of 736 cubic meters
The proposed amendments are to:
- upgrade the sewage treatment system to consist of the following, rated for 34,400 liters per day:
- revise the pre-treatment system, including:
- addition of two (2) 4,500 liter grease interceptors connected in series servicing Commercial building “B”
- increase volume of flow equalization tank from 18,150 liters to 27,500 liters
- revise primary treatment system to increase volume of sludge storage/primary clarification tank from 27,320 liters to 68,200 liters
- revise secondary treatment system, from a “WSB Clean Pro Sewage Treatment Plant” to a moving bed bioreactor (MBBR) sewage treatment plant
- revise denitrification system, from two (2) 36,300 liter NITREX filters to one (1) 68,200 liter NITREX filter
- addition of tertiary treatment system, consisting of one (1) 15,900 liter Bioreactor # 3/tertiary clarifier tank
- revise the pre-treatment system, including:
Revise effluent pump tank from 6,800 liters to 9,000 liters, discharging to the approved subsurface disposal system.
