Description of instrument
The purpose of this application is to create one (1) new lot for permanent residential purposes by severing PIN 42089-0785 from the abutting PIN 42089-0242 to correct a Planning Act violation which occurred August 1970. Both the proposed severed lot and the proposed retained lot would be approximately 64 hectares, with 805 metres of frontage and a depth of 805 metres.
Condition 6 for the requirement of a noise/dust/odour study (due to land use compatibility concerns) has been deleted and replaced with:
- Planning Act, the owners shall prepare and enter into a Consent Agreement with the Ministry of Municipal Affairs and Housing, to the Ministry’s satisfaction, addressing the use and potential development of the retained lands, including:
- a restrictive covenant, prepared to the satisfaction of the Ministry of Municipal Affairs and Housing, to be registered on the title of PIN 42089-0242, prohibiting the use of the lands for a sensitive land use, such as resource-based recreational or permanent residential use, or for any other sensitive land use as defined in the Ministry of the Environment, Conservation and Parks Guideline D-6: Compatibility between Industrial Facilities and Sensitive Land Uses
- the Consent Agreement will be registered on the title of PIN 42089-0242
- e.g. registering the restrictive covenant and Consent Agreement on title);
- provisions relating to the enforcement of the Consent Agreement and compliance with the restrictive covenant.
