The approval permits the company to receive, temporarily store and transfer blue box waste generated in Ontario. The site is limited to the receipt of 50 tonnes of waste per day, with an on-site maximum storage capacity of 50 tonnes at any one time. Waste management operations will be conducted indoor with only contained storage being permitted outdoors.
The terms and conditions of the Environmental Compliance Approval (ECA) for a waste disposal site will ensure that waste is managed in a manner which is protective of the health and safety of the environment and public.
The ECA for a waste disposal site can be found below and includes terms and conditions requiring:
- record keeping
- complaint response procedures
- reporting to the ministry
- staff training and inspections
- spill response
- stormwater management
- nuisance control
- site decommissioning/closure

The comment received for consideration did not oppose the proposal, but did make few requests with respect to the proposal. The comment requested the following:
- Site fencing to ensure a clear delineation in property
- Removal of large trees near the shared property boundary
- Trucks to approach the site via Jones Road and not Tailleau Road
- Keep property clean
The ECA cannot restrict which roads vehicles take to arrive at the site (since the roads are not subject to the ECA) or compel the owner to remove trees on the property, however, the design of the site includes the full property to be enclosed with fencing and housekeeping/inspection procedures intended to ensure a clean site is maintained.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

This proposal is for an Environmental Compliance Approval (ECA) to GFL Environmental Inc. to develop and operate a waste transfer station at 112 Jones Road, Kenora, Ontario.
GFL is proposing to develop and operate a non-hazardous solid waste transfer station on a property located at 112 Jones Road in Kenora, Ontario. The facility will receive up to a maximum of 2,500 tonnes per year of solid non-hazardous waste consisting of blue box recyclable waste generated by residential, industrial commercial and/or institutional sources.
GFL seeks approval for a maximum on-site waste storage of up to 50 tonnes at any time with all of the waste being stored indoors and/or outdoors within an enclosed transfer trailer. This proposal also seeks a limit of up to 50 tonnes of waste to be transported off-site each day.
The waste transfer station will receive waste from within the Province of Ontario and will operate 12 hours a day (7 a.m. to 7 p.m.) and five days a week (Monday to Friday).
Facility operations will take place within a fabric cover building with poured concrete floor and lock block push walls. New access roads will be constructed to facilitate a two-way system coming into and leaving the facility. The waste transfer station facility is part of overall GFL operations at the site.
