Approval is granted for a new Environmental Compliance Approval (industrial sewage) issued to Good's Realty Inc., for the establishment of stormwater management facilities, as part of proposed autoparts sales and warehouse building, complete with asphalt driveway and parking lot, for the storage, treatment and disposal of stormwater run-off from the site located at 6-8 Wells Street West, in Arthur, Township of Wellington North, County of Wellington, Ontario.
The proposed stormwater management works will consist of an underground storage unit for quantity control and an oil and grit separator for quality control, discharging via Roadside ditch along Wells Street West, into the Four Mile Creek/Conestogo River Watershed.

The technical reviewer reviewed and considered all received comments regarding this proposal. Responses to the subjects/concerns/issues are listed below:
Comment
- The property has been identified as not being in a Significant Groundwater Recharge Area (SGRA) nor a Highly Vulnerable Aquifer (HVA). Given that this proposal is for an auto garage, we recommend that the Ministry request a Contingency Plan and Spills Plan for the site. This plan should outline fuel and fluid/ chemical storage requirements, handling requirements, spill response measures and staff training for the site.
- It is recommended that the Ministry request and review this document to ensure there are measures in place at the site for appropriately managing the above listed activities, if occurring. It is further recommended that the Contingency Plan and Spills Plan include the following: a) the site’s location in the WHPA-D, with a vulnerability score of 6; b) reference the ~570 metres proximity to the Wells Street West municipal well; and c) that the Township of Wellington North’s Environmental Services be included in the Spills Plan as a notification (519-848-3620).
Response
- The comment acknowledged that the activities on site are not considered significant drinking water threats, which was confirmed by Ministry's source protection screening, hence specific source water conditions are not required for the site. The reviewer has included appropriate required terms and conditions in the ECA.
- Standard Spill Contingency Plan (Condition 7.0) along with Operation and Maintenance (Condition 5.0) has been included in the ECA to ensure possible spills will be addressed and stormwater management works to be operated and maintained as designed.
- The Ministry's standard condition included for the preparation of operational manual (condition 5.8),which include "a spill prevention, control and countermeasures plan including procedures for notifying the District Manager and Township of Wellington North’s Environmental Services;"
- Reporting requirements to Township of Wellington North’s Environmental Services (Condition 8.2), for occurrence of any reportable spill Spills, has been included in the ECA.
Comment
- Regarding infiltration, the roof run-off areas, catchments 201 and 202, and the asphalt area, catchment 203, are all proposed to discharge to the stormwater management facility, and ultimately to the Wells Street ditch. The run-off from the asphalt parking lot is likely to contain salt laden water during the winter months, and such, should not be mixed with ‘clean’ roof run off. We recommend that the Ministry review this design and provide best management practices for the infiltration of clean water.
Response
- The client's consultant has provided clarification and confirmed during the application review process, that they have initially looked at infiltrating the roof water, but to make the SWM design work they had to combine it with the parking lot runoff which isn’t clean, and as a result proceeded with the contained StormTech system.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal
