We are requesting that Section 3.13 of the Director’s Order be amended to require that each of the three parties post one-third of the financial assurance required in connection with the work ordered, with DiRocco and the numbered company contributing 1/3, Hamilton Beach Brands Canada contributing 1/3; and Carillion Canada Inc. contributing 1/3.

We are also requesting that, unless Carillion Canada Inc. affirms its intent to comply with the Order, that the directors and officers of Carillion Canada Inc. be added to the Director’s Order prior to issuance. The Ministry has named directors and officers in precisely these circumstances, where an insolvent or CCAA party is refusing to comply with requirements in an Order.

We are also asking that the Director consider any other mechanisms that it may have available to it to compel Carillion Canada Inc. to honour its obligations under the Director’s Order.
