Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

Proposal details

This proposal is for a new Environmental Compliance Approval for Halton Recycling Ltd., operating as Emterra Environmental, to establish a waste transfer facility for the receipt, transfer, and baling of non-hazardous solid recyclable waste from municipal and/or industrial, commercial and institutional sources, located at 28 Rawson Avenue in the City of Barrie, Ontario.

The site occupies a total surface area of 4.52 acres of land zoned for industrial use in the City of Barrie, measuring approximately 185 meters east to west and 65 to 135 meters north to south.

The facility will include the following components:

  • parking for approximately 40 waste and recyclable material collection vehicles
  • one vehicle weight scale
  • two bays for truck repair and maintenance facility
  • one truck fueling station (diesel)
  • one indoor single stream material storage bunkers for storage with a capacity of 1,010 cubic meter
  • two indoor bunkers for storage of recyclable waste material, with a capacity of 673 cubic meters each
  • two outdoor bunkers with top covers for material storage with capacities of 234 and 225 cubic meters respectively
  • a recyclable material baling facility with a daily amount of 200 tonnes of blue box recyclable materials; recyclable materials to be received at the site will consists of categories set out in Schedule 1 and 2 of Ontario Regulation 101/94
  • a transfer facility for organics and leaf and yard waste with a capacity of 30 tonnes per day

The site will be operating on a 24/7 basis. The facility will serve the market needs for the Province of Ontario.
