Decision details
On January 21, 2022, we approved a new Environmental Compliance Approval (industrial sewage) No. 4924-C93TT3 to Environmental 360 Solutions Ltd. at 571 Welham Road and 575 Welham Road in the City of Barrie. The sewage works will service the proposed non-hazardous waste transfer/processing facility and includes:
- a storm sewer system comprised of catchbasins, manholes and sewers for stormwater conveyance
- roof top storage using flow controlled roof drains for quantity control
- one infiltration gallery for the infiltration of non-contact stormwater
- one lined bioswale and one lined permeable paver area for the capture and treatment of stormwater
- three underground storage tanks, two for quantity control and one for the storage of emergency fire suppression materials, all equipped with leak detection measures
- one stormwater filter for quality control with a gate valve on the outlet
The treated stormwater meeting the ministry requirements will discharge to Welham Road.

Effects of consultation
The information below summarizes the public's comments and how we considered and addressed them as part of our decision:
- Concern regarding the need to contain 1,200,000 litres of fire suppression materials with leak detection measures and operating and inspection protocols.
Response: The conditions of the Environmental Compliance Approval require the owner to provide 1,200,000 litres of storage of fire suppression materials with secondary containment, leak detection measures and a requirement to record operating and inspection protocols.
- Concerns regarding the need to comply with municipal bylaws.
Response: Municipal bylaws are under municipal jurisdiction which are out-of-scope of the Environmental Compliance Approval review process.
- Concerns regarding the need for an operations manual.
Response: Condition 7.2 of the Environmental Compliance Approval requires the owner to prepare an operations manual.
- Concerns regarding the need to notify the City of Barrie of all spills into Municipal Sewage Works or onto Municipal Property.
Response: Condition 7.2 of the Environmental Compliance Approval requires the owner to notify the City of Barrie during spills.
- It is recommended that the City of Barrie, Barrie Fire and Emergency Services and the Ministry of Labour be consulted during the ministry's review of this application.
Response: The City of Barrie, Barrie Fire and Emergency Services and the Ministry of Labour were consulted during the ministry's review of this application.
- Concerns regarding venting, dust collection, tire storage requirements, site security, residual waste, and waste processing.
Response: These concerns are related to the waste and air/noise Environmental Compliance Approval applications and are out of scope of the sewage works Environmental Compliance Approval review process.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.

To seek leave to appeal, you need to do these three things:

- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:

- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

Proposal details
This proposal is for a new ECA for industrial stormwater management works for a proposed tire processing facility to be located at 571 Welham Road in the City of Barrie.
The stormwater management works proposed for the facility involves implementation of storm sewers/manholes/catch basins and storm controls including bio-swales, an infiltration gallery, a StormFilter unit, and storage tanks with an orifice control.
The stormwater management controls are proposed to achieve water balance, quality, and quantity objectives for the site.
