Bulletin summary

On April 6, 2021, the Minister of Municipal Affairs and Housing filed an Amending Zoning Order with the Registrar of Regulations as Ontario Regulation (O. Reg.) 260/21 which amends O. Reg. 474/20 to provide relief from certain zoning requirements to facilitate the development of a 320-bed long-term care home on a portion of the property. 

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act regulates the use of land and the erection, location and use of any building and structure on the land. 

O. Reg. 474/20, made on August 28, 2020, permitted a 320-bed long-term care home on a portion of the lands. This Amending Zoning Order, made pursuant to clause 47(8) of the Planning Act amends O. Reg. 474/20 to ensure that uses related to the long-term care home are permitted across the entire site. It also specifies zoning requirements related to short-term bicycle parking spaces, loading spaces, and vehicle and accessible vehicle parking spaces. The Amending Zoning Order further outlines that the development agreement referred to in section 4 of O. Reg. 474/20 is not subject to the deeming provision of section 8 of O. Reg. 474/20. 

O. Reg. 260/21 applies to lands municipally known as 2111 Finch Avenue West located in the City of Toronto. For illustrative purposes, the lands are shown in the map the link to which is set out below.
