Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin as because the proposal was posted on April 2, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consult with the public on this approval by posting ERO # 019-1584 with a 45 day public comment period from April 2, 2020 to May 17, 2020.
To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

We have issued an Environmental Compliance Approval (ECA) with Limited Operational Flexibility (air), which replaces all the current ECA (air) for this facility and includes the addition of new, or historically unapproved, sources for all emissions from Kiley Paving Ltd., producing hot mix asphalt, located in Bath, Ontario.
The approval includes all sources at the facility, including:
- one hot mix asphalt plant including material screening
- conveyors
- storage tanks with emissions controlled by one baghouse
- one materials depot
- one soil trummel unit
Emissions to the air from this facility include:
- particulate mater
- benzo(a)pyrene
- benzene
- naphthalene
- arsenic
- lead
- nickel
- nitrogen oxides
- other products of combustion
The ECA with Limited Operational Flexibility (air) permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (air).
The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment when it is time to renew these conditions.
Effects of comments
The ministry did not receive any comments on the proposal.
