We issued an Environmental Compliance Approval to Clean Soils Services Ltd. for their 85 Vickers Road, Toronto location for the use and operation of an excess soil processing site. Excess soils, including dry and liquid soils, will be received for processing and eventual reuse off-site. Tonnages are limited to:
- 965 cubic metres of excess soil per day
- 10,660 cubic metres total storage
Processing at the site will include:
- the receipt of excess soil
- the mechanical dewatering of liquid soils using shaker screens and centrifuges
- the clarification of process waters
- the blending of soil
- the transfer of residual waste and processed soil from the site for disposal or reuse
All soils leaving the site for reuse must be tested to ensure compliance with Ontario Regulation 406/19 and the ministry's Soil Rules document.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?

Proposal details
This proposal is for a new Environmental Compliance Approval (waste disposal site - processing) for Clean Soils Services Ltd. The non-hazardous waste processing facility is located on a site that is 2.7 acres in area at 85 Vickers Road, Toronto, Ontario. Approval is sought for the receiving, processing and transfer of non-hazardous liquid soil/ soil material from clean soil locations.
The maximum waste to received daily will be 665 cubic meters of liquid soils and 660 tonnes of dry soils, and the maximum on-site storage capacity will be 1,367 cubic meters of process water and 18,983 tonnes of soil.
The area of operation will be from the clean soil locations within the Province of Ontario.
The hours of operation will be Monday to Friday from 7:00am to 7:00pm and Saturday from 9:00am to 7:00pm for shipping and receiving to and from the site. Processing and management of the liquid soil will occur indoors 24 hours a day, 365 days a year.
