We issued an Environmental Compliance Approval to AJ Jade Holdings Inc. for the use and operation of a waste disposal site that processed liquid soil for reuse purposes.
Tonnages are limited to 300 cubic metres per day receiving and 750 cubic metres total storage. Operations at the site will include:
- the receipt of liquid soils
- the mechanical dewatering of soils using shaker screens and a centrifuge
- the clarification of process waters using polymers and coagulants
- the transfer of residual wastes and recovered soils from the site.
All soils leaving the site for reuse must be tested to show compliance with Ontario Regulation 406/19 and the ministry's Soil Rules document.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?

Proposal details
This proposal is for an Environmental Compliance Approval (Waste Disposal Site) for the use and operation of an excess soil site located at 4894 Mount Albert Road, Mount Albert, Ontario (north side of Mount Albert Road, west of Hwy. 48) to meet the requirements of Ontario Regulation 406/19.
Additional details
- the site is located in a rural industrial area in the Town of East Gwillimbury, and is approximately 1 km from the nearest residential area
- the site is 7.84 hectares (approximately 19.36 acres) in size
- the proposed hours of operation would be 24 hours per day, 6 days a week - 365 days per year
- the facility will serve the Province of Ontario
- AJ Jade Holdings Inc. is proposing to manage up to 50 cubic meters (100 tonnes) of excess soil (consisting of clean soils from residential/commercial/industrial sources and wet soils) per day.
- the total amount of excess soil stored at the site will not exceed 400 cubic meters (800 tonnes) at any one time
- the soil quality will be determined by a Qualified Person (QP) at the site where the soil is generated prior to shipment to the AJ Jade Holdings Inc. site
- the excess soil will be managed in a separate building to be built at the north side of the site
- the soil will be off loaded into concrete pits at the entrance to the building; an on-site employee will make observations of the soil to assess quality, the soil will then be conveyed through the dewatering system and stored in the building
- the soil will also be sampled/analyzed prior to shipment off-site to various permitted/approved receiving sites for disposal or reuse
- the facility will not accept putrescible wastes, hazardous wastes, liquid wastes, asbestos, sewage or combustible gas cylinders
