2. That the application to transfer noted in Condition 2 shall not identify the transferors and the transferees as the same person.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

Who can appeal

A notice of appeal can’t be submitted by:

  • an unincorporated group

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Description of instrument

The purpose of this application is to create of one (1) new resource-based recreational lot by severing PIN 42150-3052 and PIN 42150-3131 on Treaty Island in Lake of the Woods. The 1.13 hectare property currently holds two cottages serviced by one sewage system and individual lake water. Both severed and retained lots are proposed to be 0.565 hectares in size with 50 metre frontages and 103 metres of depth. The lots are proposed to be serviced by individual sewage systems and lake water. The property is currently accessed by water from a City of Kenora deeded boat slip.
