A man-made diversion channel or ditch extends from Willow Creek to adjacent to the pond system located on the property. The ditch is a dead end (i.e. it does not freely flow into the pond system). During the irrigation season, water is transferred by pumping from a location in the diversion ditch (i.e. Source 1) to the pond system (Source 2), as needed. Irrigation occurs from the pond system. The restrictions in this permit on the rate and amount of water that can be taken from Willow Creek (Source 1) apply to the pumping of water from the man-made ditch to the pond system.

Between June 15 and September 15 of each year, the maximum rate of water taking from Willow Creek (Source 1) shall not be more than 300 litres per minute (L/min), with a corresponding maximum daily amount of 432,000 litres.

Appeal process for decisions published before June 1, 2021

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

  • decision that you wish to appeal
  • grounds for granting leave to appeal
