Ontario has made amendments to the Pesticides Act and O. Reg. 63/09: General, to create a simpler, more efficient process for the sale and use of all pesticides in Ontario, while ensuring strong protection for human health and the environment.
These amendments have reduced administrative burden and duplication by ending Ontario’s provincial classification of pesticides and aligning classes with the federal government’s pesticide categories, as all other provinces do.
These amendments have come into effect on May 1, 2020, as indicated on the Decision Notice (https://ero.ontario.ca/notice/019-0601) that is posted on the Environmental Registry.
Given that these amendments have eliminated Ontario’s provincial classification of pesticides, a decision to classify the pesticides in this notice can no longer be made by the ministry and in accordance with their alignment to the federal categories, any provincial classification has occurred automatically by operation of the regulation.
As such, this reclassification proposal notice is being cancelled as it is no longer relevant.
Effects of consultation

This proposal notice has been updated on January 10, 2017 to advise the public that this application is still under active review. The ministry is reviewing the comments it has received to date. The original proposal date and comment period have not been altered.
Description of instrument
The Ontario Pesticides Advisory Committee OPAC reviewed the following products and recommended that these products, currently in Class 4, should be considered for reclassification to the more restrictive Class 3, based on soil persistence.

In addition, the product Maxforce IC Professional Cockroach Gel Bait (Reg. No. 27605), currently in Class 4, should be considered for reclassification to the more restrictive Class 3, for use by individuals holding an appropriate pesticide applicator certificate or license consistent with product label statements.
Health Canada's Pest Management Regulatory Agency assesses pesticides for their risks to human health and the environment, and examines the efficacy and value of pest control products in registering products under the Pest Control Products Act for sale and use across Canada.
In Ontario, the Pesticides Act and Ontario Regulation 63/09 stipulate that federally registered pesticides must be classified in Ontario before they are legal for sale and use.
