A new Environmental Compliance Approval (ECA) was issued to Willow Cove Park Inc. for approval of upgrades to the existing works for the treatment of sanitary sewage and subsurface disposal of treated effluent from 62 existing fully serviced RV/Trailer camping sites, five existing cottages/cabins, one existing two-bedroom dwelling (Blue House), one existing portable dwelling (park model trailer), one existing recreational hall (annex building), one existing washhouse and one existing washroom building located within the existing Willow Cove Park campground located at 568 County Road 39, County of Prince Edward.

The existing Willow Cove Park campground is seasonally operated from May to October.

The existing and new works are rated for a total maximum daily flow of 31,270 litres per day.

The construction of new approved works will be completed in a phased approach in order to ensure regular operation of the campground.

The Phase 1 approved works will service 13 existing fully serviced RV/Trailer camping sites, five existing cottages/cabins, one existing two-bedroom dwelling (Blue House), one existing portable dwelling (park model trailer), one existing recreational hall (annex building) and one existing washroom building and consist of the following:

  • one existing two-compartment septic tank;
  • one new one-compartment pump chamber; and`
  • three new one-compartment temporary underground holding tanks.

The Phase 2 approved works will service 34 existing fully serviced RV/Trailer camping sites, five existing cottages/cabins, one existing two-bedroom dwelling (blue house), one existing portable dwelling (park model trailer), one existing recreational hall (annex building), one existing washhouse and one existing washroom building and consist of the following:

  • one existing two-compartment septic tank,
  • one new one-compartment pump chamber;
  • three (3) new one-compartment underground pump chambers (constructed in Phase 1 as temporary underground holding tanks);
  • two new one-compartment underground pump chambers;
  • one new two-compartment septic tank; and
  • one new raised absorption trench leaching bed.

The Phase 3 approved works will service 28 existing fully serviced RV/Trailer camping sites and consist of the following:

  • two existing two-compartment septic tanks, operating in parallel;
  • one new two-compartment septic tank;
  • one new one-compartment pump chamber; and
  • one new raised absorption trench leaching bed.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for a new Environmental Compliance Approval (sewage) for modifications to existing subsurface disposal works servicing facilities at Willow Cove Park, located at 568 County Road 39 in Consecon, Ontario. The proposed modifications consist of:

  • Phase 1:
    • the installation of three 9,000 litre holding tanks
    • one 900 litre pump chamber
  • Phase 2:
    • a 39,000 litre septic tank
    • a 9,000 litre pump chamber
    • a raised (conventional) leaching bed
  • Phase 3:
    • a 15,800 litre septic tank
    • a 7,000 litre pump chamber
    • a raised (conventional) leaching bed

The daily design sanitary sewage flow is approximately 31,270 litres per day.

The proposed works will service the following facilities located at the park:

  • sixty-two trailer sites
  • five cottages
  • one portable dwelling
  • one two-bedroom dwelling
  • recreation hall
  • washroom building
